Ken Mann is AV Preeminent®, and has been inducted into peer-review organizations National Academy of Distinguished Neutrals and Arizona’s Finest Lawyers. Ken now focuses on serving as a neutral – as a court special master (e.g., for discovery disputes); as a private, FINRA, and American Arbitration Association mediator and arbitrator, including employment disputes; and as a consultant to other attorneys.
He has served on the AAA’s Large, Complex Commercial Case Panels since 1996 and has chaired, among many other matters, five statewide homeowners' insurance rate (binding) arbitrations between insurance companies and the Fla. Dept. of Financial Regulation, fka Dept. of Insurance. He was selected as the neutral chair by the two, party-appointed arbitrators. (Ken practiced in Orlando for many years until moving here in 2005 to assure the same meaningful relationship with his then-toddler grandchildren as his wife and he had enjoyed with their grandparents.)
Ken especially enjoys cases involving a variety of complex, document-intensive contractual or family relationships in real estate, general business, securities, closely held businesses, M&A, UCC/financing/secured transactions, employment, franchises, & wills/trusts/guardianships. They often involve alleged business/statutory torts, insurance issues, fiduciaries, valuation, tax, accounting and/or bankruptcy issues, etc.
Before law school, Ken was a CPA and “Big 4” audit senior. His primary clients were publicly traded mortgage portfolio and ownership portfolio REIT's and a privately held securities broker-dealer.
Ken’s CPA audit and sophisticated transactional law experience have been invaluable in:
(a) Countless state and federal trial and appellate court cases as sole or lead counsel (including bankruptcy court, 7 jury trials alleging mortgage fraud, breach of fiduciary duty, civil theft, conversion, wrongful discharge, defamation, etc., and 15+ published opinions);
(b) A myriad of arbitrations and mediations as a neutral and as advocate; and
(c) His consulting and special master services for other attorneys.
